Gard (Assuranceforeningen Gard), one of the world’s leading mutual insurance groups specialising in P&I insurance as well as marine and offshore energy coverage, held the “Gard Japan Webinar 2025: Updates of Iran/Israel Situation” on 30 June.

Joining from Singapore, Senior Lawyer Jade Park provided an overview of the criteria for applying “safe port” and “war risk” clauses in charter party agreements, in light of the growing tensions in the Middle East. She pointed out that even if the Strait of Hormuz remains open, vessels associated with Israel could still be designated as at risk. She further explained that determining such risks requires a careful assessment of the entire contract and the relevant facts, taking into account “reasonable judgement”, “contractual context”, and the possibility of “frustration”.
